About
The author of this blog site is Kevin Daehnke, the creator of the SB 989 “Bona Fide Ground Tenant” concept, which started in California. Mr. Daehnke and his law firm, Daehnke Cruz Law Group, LLP, were responsible for creating the SB 989 idea, drafting the legislation and (with the help of many good friends) shepherding the SB 989 bill through the California legislative process. Mr. Daehnke is a 27-year environmental law lawyer, with a “contaminated properties” focus. He cut his teeth at large law firms prior to starting Daehnke Cruz Law Group, seventeen years ago. His practice has naturally evolved over the years to a “Brownfields” specialty, focusing on revitalizing and reusing contaminated sites. Mr. Daehnke is a frequent author and lecturer on cutting edge Brownfields issues. A copy of Mr. Daehnke’s bio can be found at www.Daehnkecruz.com, and is also attached below.
Very interesting Kevin. We currently developing community solar projects in the Maryland/DC area, the Philadelphia suburbs as well as in Italy.
Brownfields location is the most likely one. How can you help?
Thanks
John
John – We are in the process of setting up “Working Groups” in each of several states to help address the liability issues associated with site grading and other “turning of dirt” activities at renewable energy projects on contaminated sites. It is our intention to address this liability issue (through a bifurcated cleanup/liability “ground lease” approach) so that closed landfills and other unused sites can be made available for solar energy projects. As the national White Paper we are developing sets out, these ground lease liability relief mechanisms must be established on a state-by-state basis. We are currently working closely with U.S. EPA to make sure that the state-specific mechanisms we establish will at least be given reciprocity by the federal government.
Please let me know if you would like to be part of a working group in your area. Our plan is to free up lots of sites for solar projects which might not otherwise be available to you and the communities you work with.
You can contact me directly at my email: Kdaehnke@daehnkecruz.com
I look forward to hearing from you.
